The Bass Bin – CONSUMER TERMS OF SALE.

Please read our terms and conditions carefully as they set out the terms under which Bass Bin make the products available to you. You as the customer will transact with Bass Bin (the Company).

Prices

The prices payable for the items that you order are clearly set out on the web site. All prices are expressed inclusive of any VAT payable. (Store prices are different from our website) The price of the items does not include the delivery charge. Delivery charges vary with products of different weights. Prices can change and we always bring you the latest prices as soon as possible. The cost of the delivery is discounted when you place an order and should the goods be returned without any fault than the full cost of delivery will be applied.

Product dimensions, weights, colors & specifications

It is important to note that the product dimensions do not include any protruding features such as, controls and handles etc. Product dimensions represent the casing of the product only.

Whilst we try to be as accurate as possible, all sizes, weights and measurements quoted on this website are approximate.

Images of the products shown on this website are for illustrative purposes only. We have made every effort to display all product colors accurately. However we cannot guarantee that the image displayed on your monitor will accurately reflect the true color of the product delivered to you. Please be aware that colors may differ between manufacturers.

Whilst every effort has been made to ensure that product specifications are correct on this website due to continual product development through research, design and manufacture specifications may change without notice.

Availability

If for any reason beyond our reasonable control, we are unable to supply a particular item, we will notify you as soon as possible. Payment will be taken for out of stock products to secure stock, only if you are happy to proceed with the order and agree to wait for the product.

Contract

There will be no contract of any kind between you and us until payment for your goods is authorized by your bank or credit card issuer. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that payment for the goods is authorized, (and not before), a contract will be made between you and us. Authority for payment must be given at the time of the order. Payment for your order will be taken once stock availability has been confirmed. If for any reason the goods can not be supplied then payment will be refunded in full. Refunds can take up to 30 days as per the Distant Selling Directive Order

Any changes (such as change of delivery address, delivery time) to an order requested by customer may subject to £10 administration charge.

Delivery

Next day delivery is available on all orders in Mainland UK only and must be selected as your preferred method of delivery.

Delivery will be made to the address specified by you. Please note that our standard delivery of products is within mainland UK, including the Isle of Wight. Our courier will make all deliveries to you. We do our best to secure delivery within 24 hours following a working day, (up to 4 working days for Northern Ireland), of the date of your order. If you order and specify items with different delivery dates, we will ship them separately and you will be charged a delivery charge each time. Surcharges may apply for special deliveries where there are access restrictions. If you are not at home for a pre-arranged delivery then we reserve the right to charge you an additional delivery charge again to redeliver your order. If you wish to change the delivery date once it is agreed then please give us no less than 1 working day notice prior to delivery.

On delivery our couriers will deliver the goods unopened, it is your responsibility to check you have received the correct number of items and there is no damage, (if there is you must note this on the delivery and call us immediately) if everything is correct then you will be required to sign a Proof of Delivery which shall be conclusive evidence that you have received your order.

You agree to check the goods on receipt and inform us of any obvious external cosmetic damage following inspection of the goods on the day. If there is any obvious cosmetic external damage to the goods at the time of delivery then you agree to note these on the delivery paperwork or refuse the delivery.

Where any obvious cosmetic external damage has been noted on your Proof of Delivery this shall not affect your statutory rights. Please refer to our Returns section for information on Non Faulty and Faulty Goods.

Subject to the other provisions of these conditions we shall only be liable for any foreseeable consequence to both of us at the time you make the relevant order. Our liability shall not in any event include pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the goods.

We cannot be held responsible for delays from delivery services, adverse weather, human error or technological errors.

Special promotions have variable delivery times based the products/promotions and can take up to 3 months.

Cancellation

If you wish to cancel your order we ask that you advise us at least 1 working day before your planned delivery date and you will receive a full refund. If 1 working day notice is not given, we will not refund the delivery charge. Where the goods have been delivered to you, you may cancel the contract for up to 7 working days from the date of delivery, in line with the distance selling directive. We reserve the right to charge you to collect the goods and to charge you for any damage that may have occurred whilst the goods have been in your possession, if necessary. This does not affect your statutory rights. Please note as we process orders within minutes of you placing your order it may not always be possible to cancel the order.

Fitting, should you wish to cancel your fitting work after the booking has been made we reserve the right to charge up to 50% of the fitting value for the cost of Administration.

Please note special order Products are excluded from our Cancellation policy, so please make sure you understand what you are ordering before you place the order.

Payment

You can pay with any Delta, MasterCard, Visa card and American express. Your payment card details will be encrypted to minimize the possibility of unauthorized access or disclosure. Authority for payment must be given at the time of order. It may be necessary to re-confirm your security number for data protection reasons. Payment will be taken for out of stock appliances to secure stock, only if you are happy to proceed with the order and agree to wait for the product.

You cannot inadvertently place an order through an unsecured connection. If you do some how get pass the point of an unsecured connection please do not place and pay for your item(s).

Liability

The following provisions set out the entire financial liability of the Company (including any liability for the acts or omissions of its employees, agents and sub-contractors) to you in respect of:

  1. any breach of these conditions;
  2. any use made or resale by you of any of the goods, or of any product incorporating any of the goods; and
  3. Any representation, statement or tortuous act or omission including negligence arising under or in connection with the Contract.

All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are to the fullest extent permitted by law excluded from the Contract.

Nothing in these conditions excludes or limits the liability of the Company:

  1. for death or personal injury caused by the Company’s negligence; or
  2. under section 2(3), Consumer Protection Act 1987; or
  3. for any matter which it would be illegal for the Company to exclude or attempt to exclude its liability; or
  4. For fraud or fraudulent misrepresentation.

Subject to the above clauses:

  1. the Company’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the Contract shall be limited to the Contract price; and
  2. we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at a the time you make the relevant order. Our liability shall not in any event include loss of profit, loss of revenue, loss of business, wasted expenditure, depletion of goodwill, and loss of privacy or any other claims which arise out of or in connection with the Contract.

General

These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
